Waka provides a browser-based platform for random video chat between strangers and private meeting rooms via shareable links. The Service uses peer-to-peer (WebRTC) technology for real-time video and audio communication.
You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

We do not monitor, record, store, or review any video, audio, or text communications that occur through the Service. All communication is transmitted directly between users via peer-to-peer connections. We have no ability to control or review the content of user communications.
You acknowledge and agree that using the Service involves communication with strangers and inherently carries risks. You assume all risks associated with your use of the Service, including but not limited to exposure to content that you may find offensive, inappropriate, or objectionable. You use the Service entirely at your own risk.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components. We make no warranties or representations regarding the conduct, identity, or intentions of any other user.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WAKA, ITS OPERATORS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

You agree to indemnify, defend, and hold harmless Waka and its operators, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including attorney's fees) arising from: (a) your use of and access to the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any privacy or intellectual property right; or (d) any content you transmit through the Service.
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Waka. The Service is protected by copyright, trademark, and other applicable laws.
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator is located, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
These Terms constitute the entire agreement between you and Waka regarding the use of the Service, and supersede any prior agreements between you and Waka relating to the Service.
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will post the updated Terms on this page with a new "Last updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
